TERMS AND CONDITIONS .sr-domain names

1. The Terms and Conditions shall apply to this agreement with the Telecommunicatie Bedrijf Suriname (Suriname Telecommunications Operator - Telesur).

2. Telesur reserves the right without stating the reasons thereto, to refuse an application for a domain name.

3. The Customer declares that the data filled out on the application form are correct and complete.

4. The hosting or domain registration period shall be for a term of 1, 2, 3, 4 or 5 years, commencing as of the date of availability for the customer. The contract shall each time be renewed automatically for the term so indicated by the applicant, of 1, 2, 3, 4 or 5 years.

5. Cancellation of the domain name shall be notified to Telesur at least 1 month prior to the expiration of the registration period. This shall be done by the customer himself, by letter, fax or e-mail, with mentioning of the customer number. A premature cancellation of a domain name, host or mail account does not give any right to refund of any advance payments made by the customer.

6. Telesur is not responsible for damage ensuing from force majeure. By force majeure, Telesur means inaccessibility or dysfunctioning of the website or the mail account as a result of server maintenance, power failure, power cut-off, hacking, viruses or network interruptions. The customer is responsible to make a back-up of the website files in question.

7. Telesur shall be indemnified by the customer against any possible legal claim as regards the domain name registered by the customer or the contents of the website placed by the customer. Spamming and/or illegal actions are not allowed. Possible conflicts arising as a result thereof shall be the sole responsibility of the customer.

8. At the end of the hosting / registration period, the customer shall receive an invoice and he shall pay the same prior to the beginning of the new period. Telesur has the right to deactivate the domain name for the user in case he does not timely pay the invoice and this until the payment has been received. If the payment is not done and/or the claim runs through a collecting agency, then the domain name shall be cancelled. Deactivating or canceling the domain name shall not relieve the customer from the outstanding payment obligation.

9. Telesur has the right to terminate the agreement without refund of money, if the customer has been declared bankrupt.

10. Prices shown on the website are all exclusive of Turnover Tax.

11. Telesur reserves the right to cancel the hosting / registration prematurely in case the provisions and conditions are not complied with and this without refund of money.

12. If a domain name, host or mail account is cancelled; all files of both the host and the mail account(s) will be removed immediately.

13. Telesur has the right to adjust and amend the terms and conditions to its own discretion. Amendments shall be published on the website.

Regulations for the registration of .sr-Domain Names


Preamble

These Regulations contain the conditions that apply to a Registration Contract entered into between a Domain Name Holder and Telesur.


Definitions


Article 1


Application: the application submitted to Telesur to implement a certain transaction in connection with a Domain Name or Personal Domain Name;


Domain Name: a combination of symbols at the first level under the .sr-domain;


Domain name applicant: the intended Domain Name Holder of a Domain Name or a Personal Domain Name;


Domain Name Holder: the person in whose name a Domain Name or Personal Domain Name has been registered with Telesur;


Form: a(n) (electronic) form prescribed by Telesur to submit and application or within the framework of a certain Application of the Registration Application;


Cancellation: the termination of the registration of a Domain Name or Personal Domain Name, as a result of which the Domain Name Holder is denied the use of the Domain Name or Personal Domain Name and the registration is deleted from the Register by Telesur;


Personal Domain Name: a combination of symbols at the second level under a part solely intended for natural persons, so designated by Telesur (whether or not on request of the Domain Name applicant) under the .sr-domain at the first level;


Register: the (electronic) Domain Names and Personal Domain Names Register;


Registration Application: the application for registration of a Domain Name or Personal Domain Name;


Registration contract: the agreement between the Domain name applicant and Telesur, intended for registration and maintenance of a Domain Name or Personal Domain Name, in accordance with the Telesur model;


Regulations: these Regulations for Registration of .sr-Domain Names;


Telesur: the Telecommunicatiebedrijf Suriname (Suriname Telecommunications Operator)


Technical requirements: specific technical requirements with regard to a (Personal) Domain Name, as set forth in appendix 1 to these Regulations;


Modification Domain Name Holder: the modification of (the name of) the Domain Name Holder or a Domain Name or Personal Domain Name.



Registration of a Domain Name or Personal Domain Name


Article 2


2.1 A Domain Name may be applied on behalf of anyone, domiciled or residing anywhere in the world.


2.2 A Personal Domain Name may only be applied on behalf of a natural person, not acting in the capacity of a profession or company, residing anywhere in the world.


Article 3


3.1 The Domain Name Applicant who wishes to register a (Personal) Domain Applicant shall furnish the following documents:


a. as regards a Domain Name: a Registration Contract signed by the Domain Name Applicant, in accordance with the model drawn up by Telesur;


b. as regards a Personal Domain Name: a copy of a valid passport, ID-card, driver’s license or a copy of a recent (not older than half a year) extract from the Population Register, serving as evidence that the Domain Name Applicant is a natural person and furthermore a Registration Contract signed by the Domain Name Applicant, in accordance with the model drawn up by Telesur.


3.2 In the case a (Personal) Domain Name is applied for by a minor, a person placed under legal restraint or a person as regards to whom guardianship has been instituted, his/her legal representative or guardian shall also sign the Registration Contract. The legal representative or guardian shall in the case of a Personal Domain Name comply with article 3.1 subsection b as well.



3.3 Domain Name Applicants who do not reside or are not domiciled in Suriname shall designate an address in Suriname where written documents can be delivered to the Domain Name Applicant and summons, if any, can be issued.



Article 4


4.1 Upon submitting to Telesur the Registration application, the Domain Name Applicant shall have at his/her disposal the documents as referred to in article 3.


4.2 Upon submitting to Telesur a Registration application, the technical requirements shall have been met.


4.3 A Registration application shall only be processed on the condition that the said application has been submitted to Telesur in the manner as prescribed.



Article 5


5.1 If a Registration Application submitted by a Domain Name Applicant has been filled out in an incomplete or incorrect manner or has not been submitted in the prescribed manner, or if it turns out that the documents referred in article 3 are not in the possession of the Domain Name Applicant concerned, or if not all documents meet the requirements set by virtue of these Regulations, then the Registration shall not be further processed.






Article 6


6.1 If the Registration Application complies with the provisions laid down by or pursuant to these Regulations, Telesur shall forward to the Domain Name Applicant a confirmation of the Registration of the (Personal) Domain Name and the (Personal) Domain Name shall be included in the Register.


6.2 In the event no confirmation follows within 24 hours, the Domain Name Applicant may assume that the Registration Application was not received.


6.3 The time of forwarding to the Domain Name Applicant, the confirmation of the Registration Application by Telesur, shall apply as the time of the Registration Application.




Not processing the Registration Application


Article 7


7.1 A Registration Application shall not be further processed if one of the following circumstances occurs:


a. the Register already contains an identical (Personal) Domain Name or a Registration Application for an identical (Personal) Domain Name is already being processed;


b. the (Personal) Domain Name is a name excluded from registration by Telesur or a name temporarily or permanently withdrawn by Telesur from the registration process;


c. one or more of the data mentioned on the Registration Application are incorrect or incomplete;


d. the (Personal) Domain Name does not comply with the Technical Requirements and does not comply with the Technical Requirements within a term so set by Telesur either.


7.2 If one of the circumstances mentioned in article 7.1 occurs, Telesur shall as soon as possible following receipt of the Registration Application, forward to the Domain Name Applicant concerned a notification that the Registration Application shall no longer be processed.



Article 8


8.1 Telesur may not further process Registration Applications on behalf of a certain Domain Name Applicant if to the reasonable discretion of Telesur the following circumstances justify such:


a. In the past the Domain Name Applicant did not meet the obligations resting with him, ensuing from the Regulations or the separate provisions set by or pursuant to the Regulations.


8.2 If by virtue of article 8.1 Telesur decides not to further process the Registration Application concerned, then Telesur shall as soon as possible following receipt of the said Registration Application, forward to the Domain Name Applicant in question, a notification mentioning the reasons why they said Registration Application is no longer processed.


8.3 The Domain Name Applicant has the right within thirty (30) days following the forwarding of the notification referred to in article 8.2, to lodge an appeal against the decision of Telesur.

The appeal shall be registered by submitting to the arbitration tribunal a notification of appeal stating the reasons on which the appeal is based, in pursuance of the Arbitration Regulations for .sr-domain names, which body shall deal with the appeal.

By separate regulation, Telesur shall lay down rules for among other things the procedure and composition of the arbitration tribunal for the Arbitration Regulations for.sr-domain names, the appeal procedure and the costs for submitting and processing an appeal (See Arbitration Regulations for .sr-domain names).





Processing Registration Application


Article 9


9.1 After the (Personal) Domain Name has been included in the Register, Telesur shall include the same in the .sr-file, as a result of which the (Personal) Domain Name is published on the internet.



Obligations during the registration period


Article 10


10.1 As long as a (Personal) Domain Name has been registered in the Register, the Technical Requirements shall be met.


Article 11


11.1 The (Personal) Domain Name Holder is obliged to ensure that the data included in (the public part of) the Register of the (Personal) Domain Name Holder are correct and stay correct. If certain data in (the public part of) the Register are incorrect or incomplete, or have been amended, the (Personal) Domain Name Holder shall forthwith notify Telesur thereof in the manner as prescribed below in article 17.


Article 12


12.1 The (Personal) Domain Name Holder shall ensure that during the period in which a (Personal) Domain Name is registered, he/she is in the possession of the documents as referred to in article 3.


12.2 At the request of Telesur, the Domain Name Holder shall forward to Telesur within a term to be set by Telesur, (a copy of ) one or more of the documents referred to in article 3, or any other Form deemed necessary with regard to the (Personal) Domain Name.



Termination registration


Article 13


13.1 Telesur shall deny the Domain Name Holder the use of the (Personal) Domain Name and delete the registration if:


a. Telesur has received an authentic copy of a provisionally enforceable judgement or a final and binding judgment of a Suriname court, ordering the cancellation;



b. the Domain Name Holder requests cancellation of the (Personal) Domain Name;


c. the Registration Contract between the Domain Name Holder and Telesur is terminated;


d. it turns out that the (Personal) Domain Name no longer meets the Technical Requirements set by Telesur and does not meet the Technical Requirements within a term so set by Telesur.


13.2 Telesur shall notify the Domain Name Holder of its intended decision to deny the use of the Domain Name and to delete the registration thereof in the Register.



13.3 If it turns out that a (Personal) Domain Name does not (any longer) meet the Technical Requirements set by Telesur, Telesur may deny the Domain Name Holder the use of the (Personal) Domain Name concerned and delete the registration thereof.



Article 14


14.1 Telesur has the right to deny the Domain Name Holder the use of the (Personal) Domain Name and to delete the registration thereof if to the reasonable discretion of Telesur it has been established that one of the following circumstances occurs:


a. with the Registration Application an incorrect or false statement has been made or the statement has been made upon concealing facts and/or circumstances known to the Domain Name Applicant, which are of such a nature that the Registration Application would no longer be processed had Telesur known the same at the time of the registration;


b. it turns out that the data included in the (public part of the ) Register are no longer correct and after having been notified thereof the Domain Name Holder failed to correct this within five (5) business days. If and insofar as data are concerned as referred to in the Technical Requirements, article 13.1 subsection d shall apply;


c. it turns out that the Domain Name Holder does not have at his disposal one or more of the documents within the meaning of article 3, or any other Form within the framework of a certain Application or the Registration Application.


14.2 Telesur shall notify the Domain Name Holder of its decision to deny the use of the (Personal) Domain Name and to delete the registration thereof in the Register.


14.3 If a decision as regards cancellation and deletion within the meaning of article 14.1 has been taken, the Domain Name Holder has the right within thirty (30) days following the forwarding of the notification referred to in article 14.2, to file an appeal against the decision taken by Telesur.


14.4 The appeal shall be registered by submitting to the arbitration tribunal a notification of appeal stating the reasons on which the appeal is based, which body shall deal with the appeal.


14.5 An appeal against the decision within the meaning of article 14.2 shall result in Telesur not implementing the decision in question until a decision has been taken on the appeal.


14.6 By separate regulation, Telesur will lay down rules for among other things the procedure and composition of the arbitration tribunal pursuant to the Arbitration Regulations for .sr-domain names, the appeal procedure and the costs for submission and processing of an appeal.


14.7 If within thirty (30) days following the announcement of the decision within the meaning of article 14.2 no appeal has been submitted, Telesur will implement the decision.












Application for changes


Article 15


15.1 If the Domain Name Holder wishes to put a (Personal) Domain Name in the name of another person, he/she shall submit a copy of the Form for Modification of Domain Name Holder as prescribed by Telesur signed by the new and the current Domain Name Holder and if the new Domain Name Holder is another (legal) person, he/she shall submit a Registration Contract signed by the new Domain Name Holder.


15.2 As soon as the Domain Name Holder concerned has at his/her disposal the documents referred to in article 15.1 and furthermore has complied with the Technical Requirements, the said holder may submit to Telesur an Application for Modification of the Domain Name Holder.


15.3 In derogation of article 15.1 and 15.2, a Domain Name Holder may also submit an Application for Modification of the Domain Name Holder without having at his/her disposal a copy of the Form for Modification of the Domain Name Holder as prescribed by Telesur, if the said Domain Name Holder has an authentic copy of a provisionally enforceable judgement or a final and binding judgment of a Suriname court that stipulates that (arbitration) judgement replaces the Form for Modification of the Domain Name Holder as prescribed by Telesur.


15.4 If it turns out that the requirements for Modification of the Domain Name Holder within the meaning of article 15.1 up to and including 15.3 have not been met, or it is established that the Domain Name Holder does not have at his/her disposal the documents referred to, Telesur is entitled to annul the Modification of Domain Name Holder or to discontinue the processing of the Application to that effect.



Article 16


16.1 If a Domain Name Holder wishes to cancel a (Personal) Domain Name, he/she shall submit to Telesur a signed copy of the Cancellation Form as prescribed by Telesur.


16.2 As soon as the Domain Name Holder concerned has at his/her disposal the Form as referred to in article 16.1, he/she may submit to Telesur an Application for Cancellation.


16.3 Prior to cancelling the (Personal) Domain Name, Telesur shall request the Domain Name Holder to confirm the Application for Cancellation. After receipt of the said confirmation, Telesur shall proceed to cancellation.


16.4 If it turns out that the requirements for Cancellation within the meaning of article 16.1 up to and inclusive of 16.3 have not been met, or it has been established that the Domain Name Holder does not have at his/her disposal the documents referred to, Telesur shall not further process the Application to that effect.


Article 17


17.1 If a (Personal) Domain Name Holder wishes to adjust the data included in (the public part of ) the Register, with the exception of the name of the (Personal) Domain Name Holder, he/she shall make this known to Telesur. Adjustments may be notified in the manner as prescribed by Telesur.



Article 18


18.1 If an Application meets the provisions laid down in these Regulations, Telesur shall forward to the Domain Name Holder in question a confirmation of the Application and the change so requested shall be included in the Register. If no confirmation is made within 24 hours, the Domain Name Holder shall assume that the Application has not been dealt with.


18.2 The time of forwarding the confirmation of the Application by Telesur to the Domain Name Holder, shall apply as the time of the Application.


18.3 If it turns out that the Form submitted by the Domain Name Holder to Telesur with an Application has been filled out incompletely or incorrectly or if it turns out that the applicable documents referred to in article 15 up to and including 17 are not in the possession of the Domain Name Holder in question, or the said documents do not meet the requirements set by virtue of these Regulations, an Application shall not be further processed.


Other provisions


Article 19


19.1 Any person who holds the opinion that a certain (Personal) Domain Name is in violation of the public order or against morality, has the right after inclusion of the said (Personal) Domain Name in the Register to lodge a complaint with a Suriname court or arbitration tribunal stating the reasons on which the complaint in question has been based and this in pursuance of the Arbitration Regulations for .sr-domain names.


19.2 If a Suriname court or the arbitration tribunal for the Arbitration Regulations for .sr-domain names has decided that the (Personal) Domain Name is in violation of the public order or against morality, Telesur shall deny the Domain Name Holder the use of the (Personal) Domain Name and delete the registration thereof.


19.3 By separate regulation, Telesur shall lay down the procedure and the costs for submitting to the arbitration tribunal, a complaint and the processing thereof, and this in pursuance of the Arbitration Regulations for .sr-domain names.


19.4 Telesur shall withdraw from further registration the (Personal) Domain Name as regards to which a Suriname court or Arbitration Tribunal has determined that the same is in violation of the public order or against morality.



Article 20


20.1 Any person who states and proves that:


a. a Domain Name is identical or is in such manner similar to:

I. a brand or trade name protected under the laws of Suriname of which he/she is the rightful claimant, that confusion may be created or

II. a personal name registered in the Suriname Population Register or a name of a Suriname legal person under public law or a name of an association or foundation domiciled in Suriname under which he/she participates in social activities in a sustainable manner; and


  1. b. the Domain Name Holder has no right to or a legitimate interest in

  2. the Domain Name; and

                1. c. the Domain Name is registered or is used in bad faith, may institute against the Domain Name Holder concerned, dispute proceedings on grounds of the Arbitration Regulations for .sr-domain names in order to claim that through a Modification of the Domain Name Holder, the Domain Name is placed in his name instead of the name of the current Domain Name Holder.


20.2 Any Domain Name Holder is subject to the Arbitration Regulations for.sr-domain names and the statements made therein in case a third party by virtue of these regulations institutes against him disputes proceedings about a Domain Name registered in his name.


20.3 The Domain Name Holder undertakes in anticipation that he will accept the applicability of the laws of Suriname and the authority of the Suriname court in case a third party institutes against him judicial proceedings about a Domain Name registered in his name.


Article 21


21.1 Telesur is entitled to charge Domain Name Holders a tariff for registering and keeping registered (Personal) Domain Names and for processing Applications.


21.2 Telesur shall lay down these tariffs, the amount and the term of payment thereof by separate regulation.

21.3 In the event a Domain Name Holder is in default as regards his financial obligations by virtue of the separate regulation within the meaning of article 21.2, Telesur shall notify the Domain Name Holder that within thirty (30) days the Domain Name Holder will be denied the use of the (Personal) Domain Name and that the registration thereof will be deleted, unless within the said period, the financial obligations are as yet met by the Domain Name Holder.


21.4 Telesur reserves the right during this period of thirty (30) days, to block the (Personal) Domain Name in such manner that Applications are only dealt with after the financial obligations have been met.


21.5 If the financial obligations are not or not timely met, the use of the (Personal) Domain Name shall be denied and the registration thereof deleted.



Article 22


22.1 Telesur processes data in order to implement the Registration Contract entered into with the Domain Name Holder.


22.2 In the public part of the Register per Domain Name or Personal Domain Name among other things the following data are included subject to the cases in which the Domain Name Applicant or Domain Name Holder of a Personal Domain Name requests Telesur to have certain data be replaced by data of the Domain Name Holder, :

  1. - the Domain Name or Personal Domain Name;

- name and address of the Domain Name Holder (and if applicable: chosen address in Suriname);

- technical data.


22.3 The public part of the Register may be consulted by anyone (electronically). Restrictions with regard to consulting the public part of the Register shall apply. These restrictions shall be further determined by Telesur and published on the Telesur website. In case of violating the restrictions, Telesur may take measures against the violator.


22.4 Without prejudice to the provisions laid down in article 22.2 and in the Constitution on the duty of confidentiality as to personal data, the Domain Name Applicant and the Domain Name Holder who in connection with special circumstances object to the inclusion in the public part of the Register of one or more of the data referred to in 22.2, may apply to Telesur in writing, stating the reasons on which the request is based, not to include his/her data in the public part of the Register.


22.5 The request as referred to in 22.2 and 22.4 shall be submitted to Telesur.


22.6 The request shall be signed by the applicant. In case the request as referred to in article 22.2 and 22.4 is done by a minor, a person placed under legal restraint or a person as regards to whom guardianship has been instituted, his/her legal representative(s) or guardian shall also sign the request.


22.7 If the request does not meet the conditions laid down in article 22.4 and 22.6, Telesur shall give the applicant the opportunity to bring the request in accordance with the provisions of article 22.4 and 22.6.


22.8 Within three weeks following receipt by Telesur of the request as referred to in article 22.4, Telesur shall decide on the said request. Telesur shall notify the Domain Name Applicant or the Domain Name Holder of its decision.


22.9 Within thirty (30) days following the delivery of the notification as referred to in article 22.8, the Domain Name Applicant and the Domain Name Holder may lodge an appeal against a rejection of Telesur of a request as referred to in article 22.4.


22.10 The appeal shall be registered by submitting to the Suriname court or the arbitration tribunal a notification of appeal stating the reasons on which the appeal is based. The Suriname court or the Arbitration tribunal shall deal with the appeal.


22.11 By separate regulation Telesur shall lay down rules for among other things the procedure and composition of the arbitration tribunal, the appeal procedure and the costs for submitting and processing an appeal.



22.12 Requests as referred to in article 22.4 of these Regulations, requests as referred to in the Constitution on confidentiality of personal data as well as the lodging of an appeal as referred to in article 22.9 or otherwise applying any legal remedy against a rejection to a request to refrain from mentioning data, shall have suspensory force as regards the inclusion of data in the .sr-file and the public part of the Register, if these requests are submitted by a Domain Name Applicant. The same applies as regards the term within which legal remedies are available against a rejection on a request to refrain from including data in the .sr-file and the public part of the Register. If such requests are submitted by a Domain Name Holder, then the data concerned remain included in the .sr-file and the public part of the Register, until such a request has been granted by Telesur.


22.13 In the event a request within the meaning of article 22.4 has been declared unfounded and no appeal has been lodged within thirty days (30) days following the notification of the decision within the meaning of article 22.8, or if the appeal within the meaning of article 22.9 was rejected, Telesur shall include the (Personal) Domain Name in the .sr-file and the public part of the Register, unless the Domain Name Applicant makes known that he withdraws the Registration Application.



Article 23


23.1 Telesur reserves the right to exclude from registration certain (Personal) Domain names. On its website Telesur shall publish a non-limitative list of (Personal) Domain Names that have been excluded from registration.


23.2 Telesur reserves the right to withdraw certain (Personal) Domain Names either temporarily or permanently from registration.



Article 24


24.1 As soon as Telesur has been notified by a Suriname court that an appeal within the meaning of article 8.3 or 14.3 has been lodged, or a complaint within the meaning of article 19.1 has been submitted or that it has received a notification from the Arbitration Tribunal under the Disputes Regulation for .sr-domain names so designated by Telesur, that disputes proceedings within the meaning of article 20.2 have been instituted, Telesur shall make an entry in its Register hereof and make impossible any amendment to the status of the (Personal) Domain Name concerned (including Cancellation and Modification Domain Name Holder) and this during the processing of the appeal, the complaint or during the term in which dispute proceedings are pending.



Article 25


25.1 Telesur has the right to amend these Regulations. The intention to amend these regulations shall be published on the Telesur website at least thirty (30) days in advance. If necessary, a transitional arrangement shall be drawn up.


Article 26


26.1 Telesur is not liable for any direct or indirect damage nor for any loss of profit that the Domain Name Applicant or the Domain Name Holder may suffer as a result of or in connection with the registration or the use of the (Personal) Domain Name or the use of the Telesur website.


26.2 The only damage that Telesur will compensate is restricted to maximally the tariff that Telesur charged with regard to the registration of the (Personal) Domain Name in the calendar year concerned.



Article 27


27.1 The administration of Telesur shall provide full proof and all subject to proof to the contrary.


27.2 Notifications made by Telesur shall be deemed to have been done on the date of the forwarding.


Article 28


28.1 Telesur has the right to lay down (further) separate regulations and to take decisions in cases not provided for in the Regulations.


Article 29


29.1 These Regulations, including amendments and further regulations, if any, shall apply to all current and future (Personal) Domain Names in the Register.


29.2 These Regulations are governed by the laws of Suriname.


29.3 In case one or more provisions of these Regulations are declared invalid by a court ruling, the other provisions shall remain in full force.

Appendix1 to the registration regulations: Technical Requirements


1. The Internet standards (RFC - documents) apply. The following points constitute a supplement thereto and/or accentuation and/or further specification thereof.


2. In a (sub) domain name, only letters, figures and the minus sign may occur, subject to the following restrictions:

- a minus sign may only be between two letters and/or figures;

- a minus sign may only refer to external name servers;

- a domain name may not only consist of figures;

- a domain name must consist of at least 3 characters; a minimum of 3 characters is advised to prevent confusion with Top Level domain names. The maximum number of characters is 63.

- Aforesaid amendments apply as of October 31, 2009 to all existing and future registrations.


3. The mail server may solely generate fully qualified e-mail addresses and shall also be conformable to particularly RFC2822.


4. For each domain name there shall be a reference to a primary name server and at least one secondary name server. The name servers stated, shall preferably be on various networks.


5. The name servers stated shall be reachable from the entire Internet.

Before a domain is registered, the name servers stated, are checked.


A. SOA, NS and MX records may solely point to objects with an A record, not to objects with a CNAME record;


B. alternative MX records may not point to third parties if no permission has been obtained from the third parties in question; in case of doubt this may be verified with the third parties in question.



Glossary


A record

An A record contains the translation of a host name to an IP-Address.


CNAME

A CNAME is a domain name that is an alias for another domain name.


MX -Record

An MX-record is a Mail eXchange-record. This record specifies to which mail server the e-mail traffic is referred.


NS Record

This record reflects the IP-addresses of a name server for a certain domain name. Each domain name has minimally two NS-records.


SOA-record (Start of Authority)

The SOA-record indicates which name server has the authority over a zone.


RFC – documents (Request for Comments)

RFC-documents are documents that describe the protocols and other aspects of the Internet.

DISPUTES SETTLEMENT .sr-domAIN NAMES

  1. Any dispute that may arise on account of or pursuant to the explanation or the application of these regulations or the registration contract entered into by virtue of these regulations, including the procedures as referred to in the articles 8.3, 14.3, 19.1, 20.1c and 22.9, shall be settled by means of arbitration in pursuance of the articles 500 at seq of the Code of Civil Procedure.

  2. Any dispute action shall be commenced against Telesur and insofar as required against other natural or legal persons against whom the legal claim is enforced or co-enforced.

  3. Commencing a disputes action as referred to above, shall be done by means of a notification to Telesur by the interested party in question that a dispute exists, stating the cause of the dispute. The said notification shall also be done to the persons mentioned under subsection 2.

  4. Within 14 (fourteen) days following the notification referred to under subsection 3, the party commencing the action, Telesur and the persons mentioned under subsection 2 shall come to an agreement on the appointment of an arbitration tribunal, consisting of 3 (three) persons. If this is not done, at the request of Telesur the tribunal shall be appointed by the subdistrict court judge of the first subdistrict, and this in pursuance of the provisions laid down in article 504 of the Code of Civil Procedure.

  5. Within 14 (fourteen) days following the appointment of the arbitration tribunal, either party shall submit to the said tribunal the dispute and the other party (parties) may respond to the contents and the description of the dispute within 14 (fourteen) days. If parties cannot come to an agreement as to the contents and the description of the dispute, the arbitration tribunal shall formulate the dispute on the basis of the statements brought forward by parties and notify the parties thereof within 14 (fourteen) days following receipt of the relevant missives of parties.

  6. The arbitration tribunal shall determine the further procedure.

  7. As regards the recognition and enforcement of decisions of the arbitration tribunal, the relevant provisions of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards, New York, June 10, 1958 shall apply.

  8. Foregoing is without prejudice to the authority of the interested parties to apply to the court to take protective measures to protect their interests within that context.

  9. In connection with foregoing, the rights and obligations of parties shall remain in force also after the registration contract has terminated.

ALGEMENE VOORWAARDEN .sr-domeinnamen

1. De Algemene voorwaarden gelden voor deze overeenkomst met het Telecommunicatie Bedrijf Suriname (Telesur).

2. Telesur behoudt zich het recht voor om zonder opgave van redenen een aanvraag van een domeinnaam te weigeren.

3. Klant verklaart dat de in het aanvraagformulier ingevulde gegevens juist en volledig zijn.

4. De hosting- of domeinregistratieperiode is voor een periode van 1, 2, 3, 4 of 5 jaar met ingang van de datum van beschikbaarheid voor de klant. Het contract wordt steeds stilzwijgend verlengd voor de door de aanvrager aangegeven periode van 1, 2, 3, 4 of 5 jaar.

5. Een opzegging van de domeinnaam dient minimaal 1 maand voor de afloop van de registratieperiode kenbaar gemaakt te worden aan Telesur. Dit dient te gebeuren door de klant zelf, per brief, fax of e-mail, hierbij dient het debiteurnummer vermeld te worden. Een tussentijdse opzegging van een domeinnaam, host-, of mailaccount geeft geen recht op teruggave van de door de klant vooruitbetaalde gelden.

6. Voor schade als gevolg van overmacht is Telesur niet verantwoordelijk. Onder overmacht verstaat Telesur onbereikbaarheid of disfunctioneren van de website of mailaccount als gevolg van serveronderhoud, stroomuitval, stroomstoring, hacking, virussen of netwerkstoringen. Klant is zelf verantwoordelijk voor een back-up van betreffende website bestanden.

7. Telesur wordt door de klant gevrijwaard van alle mogelijke juridische claims met betrekking tot de door de klant geregistreerde domeinnaam of geplaatste inhoud van de website. Spamming en/of illegaal handelen is niet toegestaan, mogelijke conflicten die hierdoor ontstaan zijn allen de verantwoordelijkheid van de klant.

8. Klant ontvangt aan het eind van de hosting/registratieperiode een factuur en dient deze voor de nieuwe periode te voldoen. Telesur heeft het recht om, bij het in gebreke blijven van tijdige betaling de domeinnaam voor de gebruiker te deactiveren totdat de betaling is ontvangen. Indien betaling uitblijft en/of de vordering via het incassobureau loopt wordt de domeinnaam opgeheven. Deactivering of opheffing van de domeinnaam ontslaat de klant niet van de nog openstaande betalingsverplichting.

9. Telesur heeft het recht de overeenkomst te beëindigen, zonder teruggave van gelden, indien de klant in staat van faillissement is gesteld.

10. Prijzen die op de website worden getoond zijn allen exclusief Omzetbelasting.

11. Telesur behoudt zich het recht voor om tussentijds de hosting/registratie op te zeggen bij niet nakomen van de bepalingen en voorwaarden zonder teruggave van gelden.

12. Indien een domeinnaam, host- of mailaccount wordt opgeheven zullen direct alle bestanden van zowel de host- als de mailaccount(s) worden verwijderd.

13. Telesur heeft het recht de algemene voorwaarden naar eigen inzicht aan te passen en te wijzigen. Wijzigingen worden kenbaar gemaakt op de website.

Reglement voor registratie van .sr-domeinnamen


Preambule

Dit Reglement bevat de voorwaarden die van toepassing zijn op een tussen een Domeinnaamhouder en Telesur gesloten Registratiecontract.


Definities


Artikel 1


Aanvraag: de aanvraag aan Telesur tot het uitvoeren van een bepaalde transactie met betrekking tot een Domeinnaam of Persoonsdomeinnaam;



Domeinnaam: een combinatie van tekens op het eerste niveau onder het .sr-domein;


Domeinnaamaanvrager: de beoogde Domeinnaamhouder van een Domeinnaam of een

Persoonsdomeinnaam;


Domeinnaamhouder: degene op wiens naam een Domeinnaam of Persoonsdomeinnaam bij Telesur geregistreerd staat;


Formulier: een (elektronisch) formulier door Telesur voorgeschreven voor het doen van, of in het kader van een bepaalde Aanvraag of de Registratie-aanvraag;


Opheffing: de beëindiging van de registratie van een Domeinnaam of Persoonsdomeinnaam, waardoor de Domeinnaamhouder het gebruik van de Domeinnaam of Persoonsdomeinnaam wordt ontzegd en de registratie door Telesur wordt doorgehaald in het Register;


Persoonsdomeinnaam: een combinatie van tekens op het tweede niveau, onder een daarvoor door Telesur op het eerste niveau (al dan niet op verzoek van de Domeinnaamaanvrager) aangewezen deel onder het .sr-domein, uitsluitend bestemd voor natuurlijke personen;


Register: het (elektronisch) Domeinnamen- en Persoonsdomeinnamenregister;


Registratie-aanvraag: de aanvraag tot registratie van een Domeinnaam of Persoonsdomeinnaam;


Registratiecontract: de overeenkomst tussen de Domeinnaamaanvrager en Telesur, strekkende tot registratie en instandhouding van een Domeinnaam of Persoonsdomeinnaam, conform het model van Telesur;


Reglement: dit Reglement voor Registratie van .sr-Domeinnamen;


Telesur: het Telecommunicatiebedrijf Suriname;


Technische eisen: specifieke technische eisen met betrekking tot een (Persoons)Domeinnaam, zoals gesteld in bijlage 1 bij dit Reglement;


Wijziging Domeinnaamhouder: de wijziging van (de naam van) de Domeinnaamhouder van een Domeinnaam of Persoonsdomeinnaam.



Registratie van een Domeinnaam of Persoonsdomeinnaam


Artikel 2


2.1 Een Domeinnaam kan worden aangevraagd ten behoeve van een ieder, waar ook ter wereld gevestigd of woonachtig.


2.2 Een Persoonsdomeinnaam kan slechts worden aangevraagd ten behoeve van een natuurlijke persoon, niet handelend in de uitoefening van een beroep of bedrijf, waar ook ter wereld woonachtig.


Artikel 3


3.1 De Domeinnaamaanvrager, die een (Persoons)domeinnaam wenst te registreren dient de volgende documenten te verstrekken:


a. voor een Domeinnaam: een door de Domeinnaamaanvrager ondertekend Registratiecontract, conform het door Telesur opgestelde model;


b. voor een Persoonsdomeinnaam: een kopie van een geldig paspoort, identiteitskaart, rijbewijs of een kopie van een recent (niet ouder dan een half jaar) uittreksel uit het Bevolkingsregister, strekkend tot bewijs dat de Domeinnaamaanvrager een natuurlijk persoon is en voorts een door de Domeinnaamaanvrager ondertekend Registratiecontract, conform het door Telesur opgestelde model.


3.2 In het geval dat een (Persoons)Domeinnaam wordt aangevraagd door een minderjarige, een onder curatele gestelde of een persoon ten aanzien van wie een curatorschap is ingesteld, dient diens wettelijke vertegenwoordiger of curator het Registratiecontract

mede te ondertekenen. Ook de wettelijke vertegenwoordiger of curator dient in geval van een Persoonsdomeinnaam te voldoen aan artikel 3.1 sub b.



3.3 Domeinnaamaanvragers die niet in Suriname woonachtig of gevestigd zijn, dienen een adres in Suriname aan te wijzen, waar schriftelijke stukken aan de Domeinnaamaanvrager bezorgd kunnen worden en eventuele dagvaardingen uitgebracht kunnen worden.


Artikel 4


4.1 Bij het indienen van de Registratie-aanvraag bij Telesur dient de Domeinnaamaanvrager te beschikken over de in artikel 3 genoemde documenten.


4.2 Bij het indienen van een Registratie-aanvraag bij Telesur, dient voldaan te zijn aan de Technische eisen.


4.3 Een Registratie-aanvraag wordt slechts in behandeling genomen op voorwaarde dat deze is ingediend op de door Telesur voorgeschreven wijze.


Artikel 5


5.1 Indien een door een Domeinnaamaanvrager ingediende Registratie-aanvraag onvolledig of onjuist is ingevuld dan wel niet op de voorgeschreven wijze is ingediend, of indien blijkt dat de in artikel 3 bedoelde documenten niet in het bezit van de betrokken Domeinnaamaanvrager zijn, of niet alle documenten voldoen aan de gestelde eisen krachtens dit Reglement, wordt de Registratie-aanvraag niet verder in behandeling genomen.



Artikel 6


6.1 Indien de Registratie-aanvraag voldoet aan de bij of krachtens dit Reglement gestelde bepalingen zendt Telesur de betrokken Domeinnaamaanvrager een bevestiging van de Registratie van de (Persoons)Domeinnaam en wordt de (Persoons)Domeinnaam opgenomen in het Register.


6.2 Bij uitblijven van een bevestiging binnen 24 uur kan de Domeinnaamaanvrager er vanuit gaan dat de Registratie-aanvraag niet is ontvangen.


6.3 Het tijdstip van verzending van de bevestiging van de Registratie-aanvraag door Telesur

aan de Domeinnaamaanvrager geldt als tijdstip van de Registratie-aanvraag.




Niet in behandeling nemen Registratie-aanvraag


Artikel 7


7.1 Een Registratie-aanvraag wordt niet verder in behandeling genomen indien één van de volgende omstandigheden zich voordoet:


a. in het Register is reeds een identieke (Persoons)Domeinnaam opgenomen, dan wel er is reeds een Registratie-aanvraag daarvoor in behandeling;


b. de (Persoons)Domeinnaam is een door Telesur van registratie uitgesloten naam dan wel een tijdelijk of permanent door Telesur aan het registratieproces onttrokken naam;


c. één of meer van de vermelde gegevens in de Registratie-aanvraag zijn onjuist of onvolledig;


d. de (Persoons)Domeinnaam voldoet niet aan de Technische eisen en voldoet ook binnen een door Telesur te stellen termijn niet aan de Technische eisen.


7.2 Indien één van de in artikel 7.1 genoemde omstandigheden zich voordoet, zendt Telesur de betrokken Domeinnaamaanvrager zo spoedig mogelijk na ontvangst van de Registratie-aanvraag mededeling dat de Registratie-aanvraag niet verder in behandeling wordt genomen.


Artikel 8


8.1 Telesur kan Registratie-aanvragen ten behoeve van een bepaalde Domeinnaamaanvrager niet verder in behandeling nemen, wanneer de volgende omstandigheid dit naar het redelijk oordeel van Telesur rechtvaardigt:


a. de Domeinnaamaanvrager heeft in het verleden niet voldaan aan de op hem rustende verplichtingen, voortvloeiend uit het Reglement of de bij of krachtens het Reglement vastgestelde afzonderlijke regelingen.


8.2 Indien Telesur op grond van artikel 8.1 beslist de betreffende Registratie-aanvraag niet verder in behandeling te nemen, zendt Telesur de betrokken Domeinnaamaanvrager zo spoedig mogelijk na ontvangst van die Registratie-aanvraag een mededeling waarin gemotiveerd wordt aangegeven waarom die Registratie-aanvraag niet verder in behandeling wordt genomen.


8.3 De Domeinnaamaanvrager heeft het recht binnen dertig (30) dagen na verzending van de in artikel 8.2 bedoelde mededeling beroep aan te tekenen tegen het besluit van Telesur.

Het beroep dient te worden aangetekend door een met redenen omkleed beroepschrift in te dienen bij het scheidsgerecht, volgens het Arbitrage Reglement voor .sr-domeinnamen, welk college het beroep zal behandelen.

Telesur zal bij afzonderlijke regeling regels vaststellen voor onder meer de werkwijze en samenstelling van het scheidsgerecht voor het Arbitrage Reglement voor .sr-domeinnamen, de beroepsprocedure en de kosten voor indiening en behandeling van een beroep (Zie Arbitrage Reglement voor .sr-domeinnamen).







Afhandeling Registratie-aanvraag


Artikel 9


9.1 Nadat de betreffende (Persoons)Domeinnaam is opgenomen in het Register, zal Telesur deze opnemen in de .sr-file, ten gevolge waarvan de (Persoons)Domeinnaam op het internet bekend wordt.



Verplichtingen gedurende registratieperiode


Artikel 10


10.1 Zolang een (Persoons)Domeinnaam is ingeschreven in het Register, dient voldaan te worden aan de Technische eisen.


Artikel 11


11.1 De (Persoons)Domeinnaamhouder is gehouden ervoor zorg te dragen dat de in (het openbare deel van) het Register opgenomen gegevens van de (Persoons)Domeinnaamhouder correct zijn en correct blijven. Indien bepaalde gegevens in (het openbare deel van) het Register onjuist of onvolledig, dan wel gewijzigd zijn, dient de (Persoons)Domeinnaamhouder Telesur daarvan terstond op de hoogte te stellen op de wijze, zoals hierna beschreven in artikel 17.


Artikel 12


12.1 De (Persoons)Domeinnaamhouder dient ervoor zorg te dragen dat gedurende de periode van geregistreerd zijn van een (Persoons)Domeinnaam hij in het bezit is van de in artikel 3 genoemde documenten.


12.2 Op verzoek van Telesur doet de Domeinnaamhouder Telesur binnen een door Telesur te stellen termijn (een kopie van) één of meer van de in artikel 3 genoemde documenten, dan wel enig ander Formulier met betrekking tot de (Persoons)Domeinnaam, dat nodig geacht wordt, toekomen.




Beëindiging registratie


Artikel 13


13.1 Telesur zal de Domeinnaamhouder het gebruik van de (Persoons)Domeinnaam ontzeggen en de inschrijving daarvan doorhalen indien:


a. Telesur terzake een authentiek afschrift van een uitvoerbaar bij voorraad verklaard of een in kracht van gewijsde gegaan vonnis van een Surinaamse rechtbank heeft ontvangen, waarbij opheffing wordt bevolen;



b. de Domeinnaamhouder om opheffing van de (Persoons)Domeinnaam verzoekt;


c. het Registratiecontract tussen de Domeinnaamhouder en Telesur beëindigd wordt;


d. de (Persoons)Domeinnaam niet (langer) blijkt te voldoen aan de door Telesur gestelde Technische eisen en niet binnen een door Telesur te stellen termijn wel aan de Technische eisen voldoet.


13.2 Telesur stelt de Domeinnaamhouder op de hoogte van zijn voorgenomen besluit het gebruik van de Domeinnaam te ontzeggen en de registratie daarvan in het Register door te halen.



13.3 Indien een (Persoons)Domeinnaam niet (langer) blijkt te voldoen aan de door Telesur gestelde Technische eisen, kan Telesur de Domeinnaamhouder het gebruik van de betreffende (Persoons)Domeinnaam ontzeggen en de inschrijving daarvan doorhalen.



Artikel 14


14.1 Telesur heeft het recht de Domeinnaamhouder het gebruik van de (Persoons)Domeinnaam te ontzeggen en de inschrijving daarvan door te halen, indien naar het redelijk oordeel van Telesur vast komt te staan dat één der volgende omstandigheden zich voordoet:


a. bij de Registratie-aanvraag is een verkeerde of onwaarachtige opgave gedaan dan wel is deze gedaan onder verzwijging van aan de Domeinnaamaanvrager bekende feiten en/of omstandigheden, welke van dien aard zijn dat de Registratie-aanvraag niet verder in behandeling zou zijn genomen, indien Telesur hiervan ten tijde van de inschrijving kennis had gedragen;


b. de in het (openbare deel van het) Register opgenomen gegevens blijken niet meer juist te zijn en de betrokken Domeinnaamhouder heeft dit, na hierop te zijn gewezen, niet binnen vijf (5) werkdagen hersteld. Indien en voor zover het gegevens betreft als bedoeld in de Technische eisen is artikel 13.1 sub d van toepassing;


c. de Domeinnaamhouder blijkt niet te beschikken over één of meer van de vereiste documenten in de zin van artikel 3, dan wel enig ander Formulier in het kader van een bepaalde Aanvraag of de Registratie-aanvraag.


14.2 Telesur stelt de Domeinnaamhouder op de hoogte van zijn besluit het gebruik van de (Persoons)Domeinnaam te ontzeggen en de inschrijving daarvan in het Register door te halen.


14.3 Indien een besluit tot ontzegging en doorhaling in de zin van artikel 14.1 is genomen, heeft de Domeinnaamhouder het recht binnen dertig (30) dagen na verzending van de in artikel 14.2 bedoelde mededeling beroep aan te tekenen tegen het besluit van Telesur.


14.4 Het beroep dient te worden aangetekend door een met redenen omkleed beroepschrift in te dienen bij het scheidsgerecht, welk college het beroep zal behandelen.


14.5 Een beroep tegen het besluit in de zin van het artikel 14.2 leidt ertoe dat Telesur het besluit niet zal uitvoeren totdat op het beroep is beslist.


14.6 Telesur zal bij afzonderlijke regeling regels vaststellen voor onder meer de werkwijze en samenstelling van het scheidsgerecht, volgens het Arbitrage Reglement voor .sr-domeinnamen, de beroepsprocedure en de kosten voor indiening en behandeling van een beroep.


14.7 Indien niet binnen dertig (30) dagen na de mededeling van het besluit in de zin van artikel 14.2 een beroepschrift is ingediend, zal Telesur het besluit uitvoeren.



Aanvragen tot mutaties


Artikel 15


15.1 Indien de Domeinnaamhouder een (Persoons)Domeinnaam op naam van een ander wil zetten, dient deze een door de nieuwe en de huidige Domeinnaamhouder ondertekend exemplaar van het door Telesur voorgeschreven Formulier voor Wijziging Domeinnaamhouder en indien de nieuwe Domeinnaamhouder een andere (rechts)persoon is een door de nieuwe Domeinnaamhouder ondertekend Registratiecontract in te dienen.


15.2 Zodra de betrokken Domeinnaamhouder beschikt over de in artikel 15.1 genoemde documenten en voorts aan de Technische eisen wordt voldaan, kan deze een Aanvraag tot Wijziging Domeinnaamhouder bij Telesur indienen.


15.3 In afwijking van artikel 15.1 en 15.2 kan een Domeinnaamhouder ook een Aanvraag tot Wijziging Domeinnaamhouder indienen zonder te beschikken over een door beide partijen ondertekend exemplaar van het door Telesur voorgeschreven Formulier voor Wijziging Domeinnaamhouder, indien deze Domeinnaamhouder een authentiek afschrift van een uitvoerbaar bij voorraad verklaard of in kracht van gewijsde gegaan vonnis van een Surinaamse gerechtelijke instantie waarin is bepaald dat dat (arbitraal) vonnis in de plaats treedt van het door Telesur voorgeschreven Formulier voor Wijziging Domeinnaamhouder.


15.4 Indien blijkt dat niet is voldaan aan de vereisten voor Wijziging Domeinnaamhouder in de zin van artikel 15.1 tot en met 15.3 dan wel vast komt te staan dat de Domeinnaamhouder niet beschikt over de genoemde documenten, is Telesur gerechtigd de Wijziging Domeinnaamhouder ongedaan te maken, dan wel de Aanvraag daartoe niet verder in behandeling te nemen.



Artikel 16


16.1 Indien een Domeinnaamhouder een (Persoons)Domeinnaam wenst op te heffen, dient deze een ondertekend exemplaar van het door Telesur voorgeschreven Formulier voor Opheffing in te dienen.


16.2 Zodra de betrokken Domeinnaamhouder beschikt over het in artikel 16.1 genoemde Formulier, kan deze een Aanvraag tot Opheffing bij Telesur indienen.



16.3 Alvorens de (Persoons)Domeinnaam op te heffen, vraagt Telesur de Domeinnaamhouder de Aanvraag tot Opheffing te bevestigen. Na ontvangst van deze bevestiging zal Telesur overgaan tot Opheffing.


16.4 Indien blijkt dat niet is voldaan aan de vereisten voor Opheffing in de zin van artikel 16.1 tot en met 16.3, dan wel vast komt te staan dat de Domeinnaamhouder niet beschikt over de genoemde documenten, zal Telesur de Aanvraag daartoe niet verder in behandeling nemen.


Artikel 17


17.1 Indien een (Persoons)Domeinnaamhouder de in (het openbare deel van) het Register opgenomen gegevens, met uitzondering van de naam van de (Persoons)Domeinnaamhouder, wenst te wijzigen, dient deze dit aan Telesur door te geven. Wijzigingen kunnen worden doorgegeven op een door de Telesur voorgeschreven wijze.



Artikel 18


18.1 Indien een Aanvraag voldoet aan de bepalingen van dit Reglement, zendt Telesur de betrokken Domeinnaamhouder een bevestiging van de Aanvraag en zal de aangevraagde mutatie worden opgenomen in het Register. Bij het uitblijven van een bevestiging binnen 24 uur, kan de Domeinnaamhouder er vanuit gaan dat de Aanvraag niet in behandeling is genomen.


18.2 Het tijdstip van verzending van de bevestiging van de Aanvraag door Telesur aan de Domeinnaamhouder, geldt als tijdstip van de Aanvraag.


18.3 Indien het bij een Aanvraag door de Domeinnaamhouder aan Telesur ingediend Formulier onvolledig of onjuist is ingevuld, of indien blijkt dat de in artikel 15 t/m 17 bedoelde documenten die van toepassing zijn, niet in het bezit van de betrokken Domeinnaamhouder zijn, of genoemde documenten niet voldoen aan de gestelde eisen krachtens dit Reglement, wordt een Aanvraag niet verder in behandeling genomen.





Overige bepalingen


Artikel 19


19.1 Een ieder die van mening is dat een bepaalde (Persoons)Domeinnaam in strijd is met de openbare orde of goede zeden heeft het recht om na opname van die (Persoons)Domeinnaam in het Register een met redenen omklede klacht in te dienen bij een Surinaamse rechtbank of scheidsgerecht, volgens het Arbitrage Reglement voor .sr-domeinnamen.


19.2 Indien een Surinaamse rechtbank of het scheidsgerecht voor het Arbitrage Reglement voor .sr-domeinnamen heeft geoordeeld dat de (Persoons)Domeinnaam in strijd is met de openbare orde of goede zeden, zal Telesur de Domeinnaamhouder het gebruik van de (Persoons)Domeinnaam ontzeggen en de inschrijving daarvan doorhalen.


19.3 Telesur zal bij afzonderlijke regeling de procedure en de kosten voor indiening en behandeling van een klacht bij het scheidsgerecht, volgens het Arbitrage Reglement voor .sr-domeinnamen vaststellen.


19.4 Telesur zal de (Persoons)Domeinnaam waarvan door een Surinaamse rechtbank of Arbitrage commissie is vastgesteld dat deze in strijd is met de openbare orde of goede zeden aan verdere registratie onttrekken.



Artikel 20


20.1 Iedereen die stelt en bewijst dat:


a. een Domeinnaam identiek is aan of zodanig overeenstemt dat er verwarring kan ontstaan met een:

I. naar Surinaams recht beschermd merk of handelsnaam waarvan hij rechthebbende is, dan wel

II. een in het Surinaams bevolkingsregister geregistreerde persoonsnaam dan wel een naam van een Surinaams publiekrechtelijke rechtspersoon of een naam van een in Suriname gevestigde vereniging of stichting waaronder hij duurzaam aan het maatschappelijke verkeer deelneemt; en


b. de Domeinnaamhouder geen recht heeft op of legitiem belang heeft

bij de Domeinnaam; en

c. de Domeinnaam te kwader trouw is geregistreerd of wordt gebruikt, kan tegen de betreffende Domeinnaamhouder een geschillenprocedure instellen op grond van het Arbitrage Reglement voor .sr-domeinnamen om te vorderen dat via een Wijziging Domeinnaamhouder de Domeinnaam op zijn naam wordt gesteld in plaats van de naam van de huidige Domeinnaamhouder.


20.2 Iedere Domeinnaamhouder is onderworpen aan het Arbitrage Reglement voor .sr-domeinnamen en de daarin gedane uitspraken wanneer een derde op grond van deze regeling een geschillenprocedure jegens hem instelt over een op zijn naam geregistreerde Domeinnaam.


20.3 De Domeinnaamhouder verplicht zich er bij voorbaat toe dat hij de toepasselijkheid van Surinaams recht en de bevoegdheid van de Surinaamse rechter zal aanvaarden, wanneer een derde een gerechtelijke procedure jegens hem instelt over een op zijn naam geregistreerde Domeinnaam.


Artikel 21


21.1 Telesur is gerechtigd Domeinnaamhouders een tarief in rekening te brengen voor het registreren en het geregistreerd houden van (Persoons)Domeinnamen en voor het in behandeling nemen van Aanvragen.


21.2 Telesur zal deze tarieven, de hoogte en de betalingstermijn daarvan bij afzonderlijke regeling vaststellen.


21.3 Indien een Domeinnaamhouder in verzuim is aangaande zijn financiële verplichtingen op grond van de afzonderlijke regeling in de zin van artikel 21.2, wordt door Telesur aan de Domeinnaamhouder medegedeeld dat binnen dertig (30) dagen de Domeinnaamhouder het gebruik van de (Persoons)Domeinnaam wordt ontzegd, en de registratie daarvan wordt doorgehaald, tenzij de financiële verplichtingen alsnog door de Domeinnaamhouder binnen die periode worden voldaan.

21.4 Telesur behoudt zich het recht voor om gedurende deze periode van dertig (30) dagen de (Persoons)Domeinnaam zodanig te blokkeren dat Aanvragen niet in behandeling worden genomen, totdat aan de financiële verplichtingen is voldaan.


21.5 Indien niet of niet tijdig aan de financiële verplichtingen wordt voldaan, wordt het gebruik van de (Persoons)Domeinnaam ontzegd en de registratie daarvan doorgehaald.



Artikel 22


22.1 Ter uitvoering van het met de Domeinnaamhouder gesloten Registratiecontract worden door Telesur gegevens verwerkt.


22.2 In het openbare deel van het Register van worden per Domeinnaam of Persoonsdomeinnaam behoudens in de gevallen dat de Domeinnaamaanvrager of Domeinnaamhouder van een Persoonsdomeinnaam Telesur verzoekt bepaalde gegevens te doen vervangen door gegevens van de Domeinnaamhouder, per (Persoons)Domeinnaam onder meer de volgende gegevens opgenomen:

- de Domeinnaam of Persoonsdomeinnaam;

- naam en adres van de Domeinnaamhouder (en indien van toepassing: gekozen adres in Suriname);

- technische gegevens.


22.3 Het openbare deel van het Register kan door een ieder (elektronisch) worden geraadpleegd. Er gelden nader door Telesur te bepalen en op de website van Telesur te publiceren restricties ten aanzien van het raadplegen van het openbaar deel van het Register. Bij overtreding van de restricties kan Telesur maatregelen treffen tegen de overtreder.


22.4 Onverminderd het in artikel 22.2 en in de Grondwet bepaalde over geheimhoudingsplicht persoonsgegevens, kunnen de Domeinnaamaanvrager en de Domeinnaamhouder die in verband met bijzondere omstandigheden bezwaar hebben tegen opname in het openbare deel van het Register van één of meer van de in 22.2 bedoelde gegevens, Telesur schriftelijk en gemotiveerd verzoeken geen opname van zijn gegevens in het openbare deel van het Register te doen.


22.5 Het verzoek als bedoeld in 22.2 en 22.4 wordt ingediend bij Telesur


22.6 Het verzoek wordt ondertekend door de verzoeker. Ingeval het verzoek als bedoeld in artikel 22.2 en 22.4 gedaan wordt door een minderjarige, een onder curatele gestelde of een persoon ten behoeve van wie een curatorschap is ingesteld, wordt het verzoek mede ondertekend door diens wettelijke vertegenwoordiger(s) of curator.



22.7 Indien het verzoek niet voldoet aan de in artikel 22.4 en 22.6 gestelde voorwaarden, stelt Telesur de verzoeker in de gelegenheid het verzoek binnen vier weken in overeenstemming te brengen met het bepaalde in artikel 22.4 en 22.6.


22.8 Binnen drie weken na ontvangst van het verzoek als bedoeld in artikel 22.4 door Telesur, beslist Telesur op het verzoek. Telesur stelt de Domeinnaamaanvrager of de Domeinnaamhouder op de hoogte van zijn besluit.


22.9 De Domeinnaamaanvrager en de Domeinnaamhouder kunnen tegen een afwijzende beslissing van een verzoek als bedoeld in artikel 22.4, binnen dertig (30) dagen na verzending van de in artikel 22.8 bedoelde mededeling, beroep aantekenen tegen het besluit van Telesur.

22.10 Het beroep dient te worden aangetekend door een met redenen omkleed beroepschrift in te dienen bij een Surinaamse rechtbank of Arbitrage commissie, die het beroep zal behandelen.


22.11 Telesur zal bij afzonderlijke regeling regels vaststellen voor onder meer de werkwijze en samenstelling van de Arbitrage commissie, de beroepsprocedure en de kosten voor indiening en behandeling van een beroep.


22.12 Verzoeken als bedoeld in art. 22.4 van dit Reglement, verzoeken als bedoeld in de Grondwet over geheimhouding persoonsgegevens, alsmede het instellen van beroep als bedoeld in art. 22.9 of het anderszins aanwenden van enig rechtsmiddel tegen een afwijzende beslissing op een verzoek tot het achterwege laten van vermelding van gegevens, hebben een schorsende werking ten aanzien van de opname van gegevens in de .sr-file en het openbare deel van het Register, wanneer deze verzoeken worden ingediend door een Domeinnaamaanvrager. Hetzelfde geldt ten aanzien van de termijn waarbinnen rechtsmiddelen openstaan tegen een afwijzende beslissing op een verzoek tot het achterwege laten van opname van gegevens in de .sr-file en het openbare deel van het Register. Worden dergelijke verzoeken ingediend door een Domeinnaamhouder, dan blijven de betreffende gegevens opgenomen in de .sr-file en het openbaar deel van het Register, totdat een dergelijk verzoek door Telesur is gehonoreerd.


22.13 Telesur zal indien een verzoek in de zin van artikel 22.4 ongegrond is verklaard en niet binnen dertig (30) dagen na de mededeling van het besluit in de zin van artikel 22.8 een beroepschrift is ingediend, of indien het beroep in de zin van artikel 22.9 niet is toegekend, de betreffende (Persoons)Domeinnaam opnemen in .sr-file en het openbaar deel van het Register, tenzij de Domeinnaamaanvrager te kennen geeft de ingediende Registratieaanvraag in te trekken.


Artikel 23


23.1 Telesur behoudt zich het recht voor om bepaalde (Persoons)Domeinnamen uit te sluiten van registratie. Telesur zal op zijn website een niet limitatieve lijst publiceren van (Persoons)Domeinnamen die uitgesloten zijn van registratie.


23.2 Telesur behoudt zich het recht voor om bepaalde (Persoons)Domeinnamen hetzij tijdelijk dan wel permanent te onttrekken c.q. onttrokken te houden aan registratie.



Artikel 24


24.1 Zodra Telesur ervan op de hoogte is gesteld door een Surinaamse rechtbank dat er een beroep in de zin van artikel 8.3 of 14.3 is aangetekend, dan wel een klacht in de zin van artikel 19.1 is ingediend, of van het door Telesur aangewezen Arbitrage Commissie onder de Geschillenregeling voor .sr-domeinnamen bericht is ontvangen dat een geschillenprocedure in de zin van artikel 20.2 aanhangig is gemaakt, zal Telesur hiervan aantekening maken in zijn Register en zal het enige wijziging in de status van de betreffende (Persoons)Domeinnaam (waaronder Opheffing en Wijziging Domeinnaamhouder) onmogelijk maken gedurende de behandeling van beroepschrift, klacht respectievelijk het aanhangig zijn van de geschillenprocedure.



Artikel 25


25.1 Telesur heeft het recht dit Reglement te wijzigen. Van een voornemen tot wijziging wordt minimaal dertig (30) dagen tevoren mededeling gedaan op de website van Telesur. Indien noodzakelijk wordt een overgangsregeling opgesteld.


Artikel 26


26.1 Telesur is niet aansprakelijk voor enige directe of indirecte schade, noch voor winstderving die de Domeinnaamaanvrager of de Domeinnaamhouder mogelijk zou lijden ten gevolge van of met betrekking tot de registratie of het gebruik van de (Persoons)Domeinnaam of het gebruik van de Telesur-website.


26.2 De enige schade die Telesur vergoedt, is beperkt tot maximaal het tarief dat Telesur terzake van de registratie van de (Persoons)Domeinnaam in het betreffende kalenderjaar in kwestie in rekening heeft gebracht.

Artikel 27


27.1 De administratie van Telesur levert volledig bewijs, een en ander behoudens tegenbewijs.


27.2 Door Telesur gedane mededelingen worden geacht te zijn gedaan op het tijdstip van verzending.


Artikel 28


28.1 Telesur heeft het recht (nadere) afzonderlijke regelingen vast te stellen en in gevallen waarin het Reglement niet voorziet beslissingen te nemen.


Artikel 29


29.1 Dit Reglement, met inbegrip van eventuele wijzigingen en nadere regelingen, is van toepassing op alle in het Register opgenomen en op te nemen (Persoons)Domeinnamen.


29.2 Dit Reglement wordt beheerst door het Surinaams recht.


29.3 Het bij gerechtelijke uitspraak ongeldig verklaren van één of meerdere bepalingen van dit Reglement laat overige bepalingen onverlet.




Dit Reglement voor registratie van .sr-domeinnamen is gedeponeerd bij de griffie van het Kantongerecht van het Eerste Kanton te Paramaribo onder Algemeen Register no. 094373.

Bijlage 1 bij het reglement voor registratie: Technische eisen



1. Van toepassing zijn de Internet standaards (RFC - documenten). De navolgende punten vormen een aanvulling hierop c.q. aanscherping c.q. nadere precisering hiervan.


2. In een (sub)domeinnaam mogen alleen letters, cijfers, en het minteken voorkomen, met de volgende beperkingen:

    1. - een minteken mag alleen tussen twee letters en/of cijfers staan;

    2. - een minteken mag alleen naar externe nameservers verwijzen.;

    3. - een domeinnaam mag niet alleen uit cijfers bestaan;

- een domeinnaam dient tenminste 3 tekens lang te zijn; een minimum van 3 tekens

wordt geadviseerd om verwarring met Top Level domeinnamen te voorkomen. Het

maximum aantal tekens is 63.

- bovenstaande wijzigingen zijn per 31 oktober 2009 van toepassing voor alle

bestaande en toekomstige registraties.


3. De mailserver mag uitsluitend fully qualified e-mailadressen genereren en dient zich ook overigens te conformeren aan met name RFC2822.


4. Voor elk domeinnaam dient er een verwijzing te zijn naar een primary nameserver en tenminste één secondary nameserver. De opgegeven nameservers dienen bij voorkeur op verschillende netwerken te zitten.


5. De opgegeven nameservers dienen vanuit het hele Internet bereikbaar te zijn.

Voordat een domein wordt geregistreerd, worden de opgegeven nameservers

gecontroleerd.


A. SOA, NS en MX records mogen uitsluitend wijzen naar objecten met een A record, niet naar objecten met een CNAME record;


B. alternatieve MX records mogen niet naar derden wijzen als daarvoor geen toestemming van de betreffende derden is; in geval van twijfel kan dit bij de betrokken derden geverifieerd worden.





Verklarende woordenlijst


A record

Een A-record bevat de vertaling van een hostnaam naar een IP-Adres.


CNAME

Een CNAME is een domeinnaam dat een alias is van een ander domeinnaam.


MX –Record

Een MX-record is een Mail eXchange-record. Dit record specificeert naar welke mailserver het

e-mailverkeer wordt verwezen.


NS Record

Dit record geeft de IP-adressen van een nameserver weer voor een bepaald domeinnaam. Elk

domeinnaam heeft minimaal twee NS-records.


SOA-record(Start Of Authority)

Het SOA-record geeft aan welke nameserver autoriteit heeft over een zone


RFC – documenten(Request for Comments)

RFC-documenten zijn documenten die de protocollen en andere aspecten van het Internet beschrijven


RFC 2822 (Request for Comments)

RFC voor Internet Message Format.





Geschillenbeslechting .sr-domeinnamen

 

  1. Alle geschillen, die mochten ontstaan uit hoofde of naar aanleiding van de uitleg of toepassing van dit reglement of het ingevolge dit reglement gesloten registratiecontract, waaronder begrepen de procedures als bedoeld in de artikelen 8.3, 14.3, 19.1, 20.1c en 22.9, zullen worden beslecht middels arbitrage overeenkomstig de artikelen 500 e.v. van het Wetboek van Burgerlijke Rechtsvordering.

  2. Alle geschillenprocedures worden gevoerd tegen Telesur en, voor zover vereist tegen andere natuurlijke of rechtspersonen, tegen wie de betreffende rechtsaanspraak geldend of mede geldend wordt gemaakt.

  3. Het aanleggen van een geschillenprocedure als voormeld geschiedt door een mededeling van de terzake belanghebbende aan Telesur, dat er een geschil bestaat en waaromtrent dat geschil bestaat, welke mededeling tevens gedaan wordt aan de sub 2 vermelde personen.

  4. Binnen 14(veertien) dagen na de sub 3 vermelde mededeling zullen de aanlegger van de procedure, Telesur en de sub 2 vermelde personen zich verstaan omtrent de benoeming van een arbitragecommissie, bestaande uit 3(drie) personen , bij gebreke waarvan op verzoek van Telesur de commissie zal worden benoemd door de Kantonrechter in het Eerste Kanton, overeenkomstig het bepaalde in artikel 504 van het Wetboek van Burgerlijke Rechtsvordering.

  5. Binnen 14(veertien) dagen na benoeming van de arbitragecommissie, zal de meest gerede partij het geschil aan die commissie voorleggen, waarop de wederpartij(en) binnen 14(veertien) dagen kan(kunnen) reageren met betrekking tot de inhoud en omschrijving van het geschil.

Indien partijen zich over de inhoud en omschrijving van het geschil niet kunnen verstaan, zal de arbitragecommissie op basis van hetgeen partijen naar voren hebben gebracht daaromtrent, het geschil formuleren en daarvan aan partijen mededeling doen binnen 14(veertien) dagen nadat de missives terzake van partijen zijn ontvangen.

  1. De arbitragecommissie stelt de verdere procedure vast.

  2. Met betrekking tot de erkenning en tenuitvoerlegging van beslissingen van de arbitragecommissie buiten Suriname, zijn de terzake relevante bepalingen van de Convention on the Recognition and Enforcement of Foreign Arbitral Awards, New York, june 10, 1958 van toepassing.

  3. Het vorenstaande laat onverlet de bevoegdheid van belanghebbenden om zich tot de rechter te wenden voor het treffen van conservatoire maatregelen ter bescherming van hun belangen in dat kader.

  4. De rechten en verplichtingen van partijen blijven ook na het eindigen van het registratiecontract van kracht met betrekking tot het voorgaande.



Deze Geschillenbeslechting .sr-domeinnamen is gedeponeerd bij de griffie van het Kantongerecht van het Eerste Kanton te Paramaribo onder Algemeen Register no. 094373.
